What is MEES?

 

The Department for Energy and Climate Change ("DECC") published their response to the Minimum Energy Performance Standards ("MEPS") consultation of the non-domestic private rented sector in England and Wales, on 04 February 2015. This response is set out in The Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015 (known as "MEES") is now submitted for parliamentary approval.

 

MEES sets out the minimum energy performance band of 'E' for Energy Performance Certificates ("EPCs"). After April 2018 all new letting transactions will require a minimum of an 'E' rated EPC (save those with a valid exemption). 115,685 EPCs lodged from Q1 2008 to December Q3 2018 (out of a total 659,347) in England & Wales currently fall below the minimum 'E' rating.

 

The aim of MEES is to help achieve the UK's CO2 targets by improving the energy efficiency of inefficient properties ('F' & 'G' rated).

Timescales

 

The minimum 'E' rating band for EPC is seen as a soft start to the MEES as this only applies to new letting transactions, however it is intended that after 01 April 2023, the minimum 'E' rating will apply to privately rented property within the scope of MEES.

 

With the increasing demand for high quality non-domestic buildings, this compliance requirement is also an opportunity to apprise your building portfolios and provide investor and client confidence in the quality of your property portfolios.

 

Enforcement measures

 

The MEES identifies the "enforcement authority" as the local authority who will be responsible for ensuring compliance with the requirement of MEES. The Trading Standards department of the local authority are expected to carry out enforcement, however some local authorities may appoint external providers to assist with enforcement action.
